1. General Agreement

2. Quotations, Call-Out Fees, and Payment Terms
2.1 Quotations and Estimates

Any quote or estimate provided by Hills Building Consultants is valid for 30 calendar days from the date of issue unless otherwise specified in writing.

Quotes are based on visual site observations and details supplied by the client. Unforeseen structural defects, concealed site conditions, or scope variations requested by the client will incur additional fees, which will be quoted prior to proceeding.
2.2 Call-Out and Inspection Fees

A standard call-out fee applies to all initial on-site visits, preliminary assessments, and emergency consultations. Call-out fees will be communicated and agreed upon prior to dispatching personnel to the site.
2.3 Payment Terms

Payment terms for standard consulting and inspection services are strictly payment upon completion or upon delivery of the written inspection report, unless an alternative credit arrangement has been agreed upon in writing.

For extended construction or consultancy projects, progress payments will be invoiced according to agreed milestones outlined in the project engagement agreement.

Late payments may attract an interest charge calculated daily at the rate of 10% per annum from the due date until full settlement is received, along with any recovery costs incurred.
3. Licensing, Safety Compliance, and Statutory Certificates
3.1 Licensing and Regulatory Compliance

All services rendered by Hills Building Consultants strictly adhere to relevant Western Australian statutory frameworks, including the Building Act 2011 (WA), the Building Regulations 2012 (WA), and regulations enforced by Building and Energy (WA Department of Energy, Mines, Industry Regulation and Safety).

Work is carried out by appropriately registered building practitioners and qualified consultants.
3.2 Certificates of Compliance and Documentation

Statutory documentation, including Certificates of Building Compliance (CBC) or inspection certificates, will be issued only upon satisfactory completion of work in full accordance with the National Construction Code (NCC) and Australian Standards, and subject to full receipt of outstanding client balances.
3.3 Site Safety and Access

The client must ensure safe, clear, and unhindered access to the subject property, including roofs, sub-floors, and perimeter boundaries, at the scheduled appointment time.

We reserve the right to suspend or cancel on-site operations if working conditions present a hazard to health and safety, in compliance with the Work Health and Safety Act 2020 (WA). Call-out fees will remain payable in such circumstances.
4. Site Constraints and Limitation of Liability
4.1 Pre-Existing Infrastructure and Concealed Conditions

Perth property sites frequently present unique environmental and structural challenges, including reactive clay soils (e.g., Perth Hills region), coastal sandy soil conditions, heritage masonry work, aging utility services, or latent pest damage (such as subterranean termites).

Hills Building Consultants accepts no liability for pre-existing structural defects, concealed soil instability, or underground service damage not reasonably detectable during a standard non-invasive visual inspection.
4.2 Extent of Inspection

Inspections are non-invasive unless explicit intrusive investigation is contracted in writing. We do not inspect hidden, covered, or obstructed areas, including behind finished walls, beneath fitted floor coverings, or inside sealed wall cavities.
4.3 Australian Consumer Law Statutory Guarantees

Nothing in these Terms excludes, restricts, or modifies any guarantees, rights, or remedies implied by the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) that cannot be legally excluded.

To the maximum extent permitted by law, our total liability for loss or damage arising out of or in connection with our services, whether in contract, tort (including negligence), or statutory duty, is limited to re-supplying the relevant services or refunding the cost paid by the client for those specific services.
5. Website Terms & Intellectual Property

Intellectual Property: All content, trade marks, text, images, inspection report templates, and logos on this website remain the exclusive property of Hills Building Consultants. Unauthorised reproduction or distribution is prohibited.
